Privacy Policy

Welcome to the 911Buddy™.  All users of this application, web site, as well as all related products and services (collectively, the “Services”), are subject to the following “Privacy Policy,” which is also incorporated by reference herein to the “User Licensing Agreement” (collectively known as the “Agreements”).  Please read this privacy policy carefully before accessing or using any part of the Service.  By accessing or using the Services, you agree that you have read, understand, and agree to be bound by this Privacy Policy and the Agreements, as amended from time to time. The Privacy Policy as provided herein complies with all provision of The Health Insurance Portability and Accountability Act (HIPAA) and is provided as to you as a function of such. If you do not wish to agree to these Terms of Use and/or the Privacy Policy, do not access or use any part of the Services.

  1. Definitions

A number of basic definitions to describe the types of information that is considered private under this policy.

  1. Your Account

You must provide accurate and complete registration information when you register to use the Service.  You are responsible for the security of your passwords and for any use of your account.

911Buddy™ reserves the right to restrict who is eligible for an account.   911Buddy™ reserves the right in its sole discretion to determine who may qualify for an account and reserves the right to reject or revoke any account at any time without liability.  911Buddy™ may enable you to create accounts for minors or other members of your family over whom you have legal authority.  You may only do so if you are the Authorized User/Authorized User-Representative, and by doing so, you certify that you have such authority.  911Buddy™ may enable you to give access to your account to Authorized Users.  When you give access to an Authorized User, you grant permission to such Authorized User to access the information contained within, and/or perform certain transactions through, your account.

  1. Collection of Your Information

We only collect information you provide to us or that you authorized to be transferred to us from a third-party provider.

PHR Data may be entered into the Services directly by you personally or via data transfer from a third-party repository, such as your insurance electronic health records or other third-party sources. With respect to your PHR Data collected from third-party sources, 911Buddy™ shall not collect such information without your specific, written authorization to do so.  When you provide such authorization, you may also be asked to designate how often updated information may be transmitted from the applicable third-party source to the Services.  Please note, if any PHR Data is released by an authorized third‑party source to the Services and later invalidated by the third-party source, 911Buddy™ reserves the right at the request of the third‑party source, to remove that PHR Data from your 911Buddy™ account record.  Modifications to your 911Buddy™ record are not automatically communicated to your insurance company or any third-party sources.

  1. Not an Emergency Service 

We ourselves do not provide or facilitate emergency services. We are not emergency medical technicians. Our services only attempt to connect you and your loved ones to a 911 dispatch facility, so that you can receive emergency medical services as coordinated by 911 dispatch.

The Services does not provide any medical services or constitute medical service and/or advice in any way. The Service does not provide emergency or urgent medical services. The services act as a third-party connection service between you, at least one of your Authorized User(s)/Authorized User(s)-Representative(s), and a 911 dispatch facility that is local to you or in a location that could adequately provide you with access to emergency medical services as coordinated by the 911 dispatch facility.

  1. Use of Your Information

We only provide information to those people you expressly authorize us to provide your information to.

When you provide Personal Information through the Services, you provide 911Buddy™ authorization to use and distribute it in connection with the Services.  However, 911Buddy™ may use Personal Information only as permitted by this Privacy Policy and applicable law.

Because your 911Buddy™ account is controlled by you and remains with you so long as you choose, the information within it is considered Personally Identifiable Information that is governed by the privacy and security standards of the FTC and its Health Breach Notification Rule. The FTC requires companies to follow their written privacy policies and agreements with consumers. In the event of a Breach of a consumer’s Personally Identifiable Health Information, 911Buddy™ is required to notify the consumer and the FTC of the event in accordance with 16 C.F.R. – 318. The health information within the 911Buddy™ account is not subject to the separate requirements of HIPAA.

911Buddy™ may use non-identifiable anonymous data that is taken from the Personal Information you provide and combine it with other anonymous data to create what is referred to as “Aggregate Data” that may be disclosed to third parties. Aggregate Data is information that describes the habits, usage patterns and/or demographics of users as a group but does not reveal the identity of particular users.  Aggregate Data will be used to determine such things as user demographics and usage patterns for our services.  911Buddy™ may use Aggregate Data within 911Buddy™ to understand the needs of the 911Buddy™ community of users and determine what kinds of services we can offer to you.

911Buddy™ may use your PHR Data to:

  1. What Information 911Buddy™ Collects

We collect the personal/medical information that would be provided to an emergency medical services provider. But we also collect some demographic and use information about you, for the purposes of making our Services to you better. We never give away your personal information.

Before you register for the Services, 911Buddy™ may collect your information if you contact 911Buddy™ through the Internet and provide 911Buddy™ with your contact information (e.g., name, mailing address, email address and other information. 911Buddy™ will use such information for the sole purpose of informing you about the Services and inviting you to register for the Service.

To use the Services, you must complete the registration process, which includes accepting the Terms of Use and signing an Authorization for Release of Information. As part of the registration process, you may be asked to provide certain information, such as your name, mailing address, and email address. You also may be asked to confirm the information that you or a third-party service has provided to 911Buddy™ prior to registration, if any. As part of the registration process, you will also have the opportunity to provide additional information to 911Buddy™, such as information regarding your health plan, home telephone number, etc. We recommend that you provide such information, as it will enhance your use of the Services.

In general, 911Buddy™ collects all information that you supply directly to the Services. 911Buddy™ also may collect information from participating third-party providers whom you expressly authorize to use the Services with respect to you and your information (each, a “Provider” and collectively, the “Providers”). By authorizing a Provider, you also authorize 911Buddy™ to collect information regarding you from your Provider(s). Further, 911Buddy™ may collect information from other third party information providers that you expressly authorize to send information to your 911Buddy™ account (e.g., the Google Health Personal Health Record system).

911Buddy™ passively collects information from you as you navigate through our Services. 911Buddy™ may track IP addresses, use industry standard tracking devices (e.g., session and persistent cookies, flash cookies, web beacons), and electronically gather information about the technology you use to access the Services and the areas of the Services you utilize. 911Buddy™ passively collects this information for operational purposes such as evaluating, updating and improving the Services.

Cookies help us in many ways to make your visit to our websites more useful and meaningful to you. Cookies are text information files that your web browser places on your computer when you visit a website. 911Buddy™ may use such “cookie” technology to obtain non-personal information from you as an online visitor. As an example, this might entail recognizing several web page requests coming from the same computer and therefore the same visitor. Most browsers accept cookies automatically, but can be configured not to accept them or to indicate when a cookie is being sent. If you do not wish 911Buddy™ to collect cookies, you may set your browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of the Services may then be inaccessible and you may not receive the full benefits of the Services.

  1. How 911Buddy™ Uses Your Information

911Buddy™ uses your information to provide the Services as described in the User Licensing Agreement as well as to enhance the performance of the Services and/or create new services. 911Buddy™ will not use Personal Information for product development or product enhancement without your express, written permission.

We will collect metadata to thwart abuse.

911Buddy™ will not sell or rent, your Personal Information without your written consent. 911Buddy™ will not use or disclose your Personal Information, except as described in this Privacy Policy, the User Licensing Agreement, or as permitted or required by law.

  1. Sharing Your Information With Third Parties

911Buddy™ may make your Personal Information available to third parties participating in the Services that are authorized by you or as necessary to complete transactions you authorize.

911Buddy™ may disclose your Personal Information to 911Buddy™’ Service Providers that provide technical support or other services to 911Buddy™ related to the Service. All such Service Providers are subject to confidentiality obligations and may only access and utilize your data for purposes of fulfilling their obligations to 911Buddy™.

If a third party acquires the assets of 911Buddy™ related to the Services and its products and services (whether by sale, merger, change of control, bankruptcy or otherwise), your Personal Information may be transferred to the new owner(s). In such case, your Personal Information would remain subject to the provisions of the 911Buddy™ privacy policy that was in effect immediately prior to the transfer unless 911Buddy™ provides you notice otherwise.

  1. Choices You Have About How 911Buddy™ Uses Your Information

You are responsible for managing your healthcare data.

  1. Deactivating a Provider, Other Third-Party or Authorized Individual

You may revoke any Provider’s, third-party’s, or Authorized User’s authorization to communicate with you, or request information from you or your 911Buddy™ account through the Services by utilizing the account management tool of the Services. Once revoked, the Provider, third-party, or Authorized User may no longer access and use the Service with respect to you and your Personal Information. Any disclosure of your PHR Data or Personal Information made prior to the authorization revocation cannot be recalled, removed, or retrieved by 911Buddy™.  By using the Services, you agree that 911Buddy™ cannot, and has no obligation to, remove Personal Information from your Provider’s, other third-party’s or Authorized User’s records once properly disclosed.

  1. Third-party Content & Services

911Buddy™ is not responsible for and does not endorse any third-party content or services, and does not make any representations or warranties regarding their quality, content or accuracy.  911Buddy™ further does not endorse any third-party Service Providers (including Providers), products, services, opinions, or web sites accessed through the Service.  USE OF THIRD-PARTY SERVICES AND RELIANCE ON THEIR CONTENT IS SOLELY AT YOUR OWN RISK. 911BUDDY™ MAY NOT BE HELD LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF ANY THIRD-PARTY SERVICE OR CONTENT.

  1. Not Medical Advice

We ourselves do not provide medical advice. We are not doctors or medical service providers. Our services only attempt to connect you and your loved ones to a 911 dispatch facility, so that you can receive emergency medical services as coordinated by 911 dispatch.

You acknowledge and agree that neither 911Buddy™ nor the Services offer medical advice.  Any content or data accessed through the Services is for informational purposes only and is not a substitute for the professional judgment of health care providers in diagnosing and treating patients.  911Buddy™ its licensors are not responsible for the accuracy, timeliness, or completeness of your Personal Information, or for any reliance by you or any emergency medical professional on your Personal Information within your 911Buddy™ account.  911Buddy™ is not responsible for any Provider’s reliance or non-reliance on your 911Buddy™ Record, Personal Information, PHR Data or the accuracy thereof.

  1. Security Measures

Security measures can include computer safeguards, secured files, and employee security training. In addition, 911Buddy™ may be required by law to notify you about particular data breaches.

911Buddy™ uses both technical and procedural Security Measures to maintain the integrity and security of the 911Buddy™ account and other databases, including the use of firewalls. 911Buddy™ encrypts all PHR Data during transmission between your Provider and 911Buddy™. Within 911Buddy™, all Personal Information is encrypted at three levels: each individual has a unique encryption key; demographic information is encrypted; and clinical data is separately encrypted and any other security information deemed necessary.

The safety and security of your Personal Information also depends on you. Never share your password with anyone else. Notify 911Buddy™ promptly if you believe your password has been breached. Also, remember to log off of the 911Buddy™ site before you leave your computer.

  1. Security Breach Notification Requirements

Pursuant to applicable law, 911Buddy™ may be required to send you notice of security breaches or suspected security breaches that impact your Personal Information. In the unlikely event that 911Buddy™ must provide you a notice of a security breach, 911Buddy™ will send you security breach notices to the e-mail address contained in your account information unless we are otherwise required by law. Please note: many e-mail systems have built in SPAM filters. If you have one in place, you should check with your system administrator or the available instructions to confirm that e-mails from 911Buddy™ are not blocked by the filter (e.g., by confirming that the Services domain name is a permitted domain name.

  1. Terminating Your Account

You may terminate your 911Buddy™ account at any time by notifying us. In addition, except with respect to an Authorized User-Representative who establishes an account on behalf of a Dependent, 911Buddy™ will terminate your account within thirty (30) days of its receipt of a death certificate certifying your death.  With respect to an Authorized User-Representative, 911Buddy™ will terminate all accounts associated with such Authorized User-Representative within thirty (30) days of its receipt of a death certificate certifying the death of such Authorized User-Representative unless a Dependent also has a living Authorized User-Representative associated with the account.  Otherwise, 911Buddy™ will maintain and/or destroy all PHR Data and Personal Information associated with your account in accordance with its then current document retention and destruction policies. Please note that copies of your Personal Information may remain in your Providers’, other third-parties’ and Authorized User-Representative’s and/or Authorized Individual’s records.

  1. Changes to this Privacy Policy

911Buddy™ reserves the right to change the Privacy Policy in its sole discretion. In such case, 911Buddy™ will post the new Privacy Policy on the web site and the effective date of the new Privacy Policy will be clearly marked. If 911Buddy™ updates this Privacy Policy, your continued use of the Service (following the posting of the revised Privacy Policy) means that you accept and agree to the terms of the revised Privacy Policy. Remember, by using any part of the Service, you accept and agree to our Privacy Policy and privacy practices.
